Agreement

These Terms & Conditions ("Terms") govern your use of the Pyxis Studios website and the marketing services we provide. By using this website or engaging our services, you agree to these Terms. If you do not agree, please do not use the site.

Our services

Pyxis Studios provides marketing services for small businesses, including website design and development and the setup and configuration of advertising accounts (such as Google Ads, Google Business Profile, and Meta advertising). The specific scope, deliverables, timeline, and fees for any engagement will be set out in a separate written proposal or agreement.

No guarantee of results

We work hard to build effective websites and advertising campaigns, but we do not guarantee any specific number of leads, calls, sales, rankings, or advertising outcomes. Results depend on many factors outside our control, including your market, budget, pricing, and responsiveness to leads.

Client responsibilities

• Provide accurate business information and timely feedback.
• Maintain your own advertising ad-spend budgets paid directly to the ad platforms unless otherwise agreed.
• Ensure you have the rights to any content, logos, or images you provide to us.

Fees and payment

Fees, payment schedules, and any recurring charges will be described in your written agreement. Advertising budgets billed by third-party platforms (such as Google or Meta) are separate from our service fees unless stated otherwise.

Intellectual property

Upon full payment, you own the final website deliverables created for your business, except for third-party components, fonts, or licensed assets, which remain subject to their own licenses. The Pyxis Studios name, logo, and branding remain our property.

Third-party services

Our services rely on third-party platforms such as Google and Meta. Your use of those platforms is subject to their own terms and policies, and we are not responsible for their availability, decisions, or changes.

SMS / text messaging terms

Pyxis Studios LLC sends text message updates and responses to consumer customers about pricing and products offered with marketing partners.

When you opt in to the service, we may send you a message to confirm your signup. Message and data rates may apply. Message frequency varies. Text "HELP" for help. Text "STOP" to cancel.

You can cancel the service at any time. Just text "STOP" to (626) 415-0375. After you send the message "STOP" to us, we will reply to confirm that you have been unsubscribed. After this, you will no longer receive messages from us. If you want to join again, just sign up as you did the first time, and we will start sending you messages again.

If at any time you forget what keywords are supported, just text "HELP" to (626) 415-0375. After you send the message "HELP" to us, we will respond with instructions on how to use our service and how to unsubscribe.

Participating carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, U.S. Cellular, Boost Mobile, MetroPCS, Virgin Mobile, Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central, IL (ECIT), Cellular One of Northeast Pennsylvania, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless).

Carriers are not liable for delayed or undelivered messages.

Limitation of liability

To the fullest extent permitted by law, Pyxis Studios will not be liable for any indirect, incidental, or consequential damages arising from your use of this website or our services. Our total liability for any claim will not exceed the amount you paid us for the services giving rise to the claim.

Termination

Either party may end an engagement as described in the applicable written agreement. Fees for work already performed remain payable.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
